Distance Subscription Contract

This is a subscription (continuing performance) contract concluded between the seller and the consumer using distance communication tools only, without the parties being physically present. It is concluded by your electronic confirmation and takes effect from that moment.

2. Buyer / consumer
The buyer is identified by the name and e-mail address given when the account is opened. Invoices and notices are sent to the e-mail address on the account; keeping it current is the buyer's responsibility.
3. Essential characteristics of the service
METAR & TAF 3D is an internet-based software service that collects, decodes and visualises aviation weather data (METAR, TAF, SIGMET/AIRMET and numerical weather prediction models). Nothing physical is delivered; the service is supplied electronically, immediately and on a continuous basis.
- Free scope: live map, report decoding, runway/crosswind calculation and a time-limited meteogram.
- Paid modules: extended meteogram, winds aloft, detailed briefing, alerts, trend and statistics archive, model comparison and data export. The pricing page always shows which module belongs to which plan.
- Technical requirements: a current web browser and an internet connection. Full functionality requires WebGL support. No additional hardware or licence is needed.
- Interoperability: the service uses standard web technologies; exported data (Pro plan) is provided in common file formats.
- Technical protection measure: access to paid modules is limited to the plan assigned to your account. No other digital rights management is applied.
4. Price, payment and invoicing
- Subscription fees are stated in Euro (EUR) and shown on the pricing page as the total amount including taxes:
- Free — free of charge.
- Pilot — 5.99 EUR per month or 49.00 EUR per year (about 32% off on annual payment).
- Pro — 11.99 EUR per month or 99.00 EUR per year (about 31% off on annual payment).
- There are no delivery, shipping or similar additional costs beyond the amounts shown. In countries where sales tax is not included in listed prices — notably the United States and Canada — the applicable local sales tax is added to the amount at checkout and shown there. Currency conversion, cross-border transaction or transfer fees charged by your own bank are your responsibility.
- Payment is collected through the payment institution identified at checkout. The seller never sees or stores your card details; they are tokenised by the payment institution.
- For purchases made through app stores (App Store, Google Play), collection, refunds and cancellation are governed by that store's own rules and agreement.
- The invoice is sent electronically to the e-mail address on your account after payment. For a business invoice, send us your tax details before paying.
5. Term, automatic renewal and price changes
- The subscription runs for the billing period you choose (monthly or annual) and renews automatically for the same period unless cancelled. There is no minimum commitment; you may end it at any time from the end of the first period.
- Renewal is charged at the tariff in force at the end of the period. Prices are never changed silently: any increase or material change to what a plan contains is notified by e-mail at least 30 days before the renewal date. If you cancel before renewal after such a notice, you pay nothing further.
- You can cancel from the subscription screen in your account or by sending notice to the e-mail above. No reason is required and cancellation is free of charge.
- On cancellation your plan stays active until the end of the period you have paid for and then drops to the free scope. Your account and saved settings are not deleted.
6. Trial period
- New accounts get every module free for 15 days. No card details are requested and the trial does not convert into a paid subscription by itself.
- If you do not pay at the end of the trial, the account simply moves to the free scope. Nothing is charged.
7. Performance and access
- The service is made available immediately after payment is confirmed, and within 24 hours at the latest. There is no separate delivery process and no delivery cost.
- Target availability is 99% per month. Maintenance, outages caused by our infrastructure provider and failures at upstream data sources (NOAA/AWC, Open-Meteo, OpenAIP) fall outside this figure and are announced in advance where possible.
- The service depends on third-party data sources. If one of them shuts down permanently, the seller will make reasonable efforts to move to an equivalent source; where that is not possible, a pro-rata refund is made for the affected module.
8. Right of withdrawal and its exception
- In distance contracts the consumer has the right to withdraw within 14 days of the conclusion of the contract, without giving any reason and without penalty.
- Mandatory consumer rights are not affected.

9. Aviation liability limit
- The seller's liability is in all cases limited to the subscription fee paid for the period in dispute. Liability for wilful misconduct and gross negligence, and for death, personal injury or damage to health, falls outside this limit.
10. Intellectual property and limits of use
- All rights in the software, interface, decoding algorithms, blend model and visualisations belong to the seller. The subscription grants you a non-transferable, non-exclusive, personal right of use.
- Sharing an account, bulk scraping with automated tools, reverse engineering and reselling the service are prohibited. Raw METAR/TAF data comes from public sources and is not subject to this restriction.
11. Suspension and termination by the seller
- If payment cannot be collected, the contract is materially breached or the service is abused, the seller will first give notice with a reasonable period to remedy; if the breach is not remedied, the subscription may be suspended or terminated.
- If the seller discontinues the service entirely, it will give at least 30 days' notice and refund the unused period pro rata.
12. Force majeure
In events beyond the parties' control — natural disaster, war, cyber-attack, infrastructure and communication outages, decisions of public authorities — obligations are suspended for the duration of the impediment. If it lasts more than 30 days either party may terminate without compensation and the unused period is refunded pro rata.
13. Amendment and entry into force
- Material changes to this text are notified by e-mail at least 30 days before they take effect; if you do not accept them you may terminate free of charge within the notice period.
- The contract is concluded upon your electronic confirmation; a copy is sent to your account e-mail address and remains accessible from this page at all times.
14. Complaints and dispute resolution
- Please contact us first; we answer within 30 days at the latest.
- Consumers resident in Türkiye may apply to the District/Provincial Consumer Arbitration Committees or the Consumer Courts under Law No. 6502, according to the monetary thresholds announced each year by the Ministry of Trade. Below the threshold, application to the arbitration committee is mandatory.
- Consumers resident in the EU may use the European Commission's Online Dispute Resolution (ODR) platform.
- This contract is governed by Turkish law. The mandatory consumer protection rules of the country where the consumer is habitually resident remain reserved.
15. Personal data and evidence
- Your personal data is processed as described in the Privacy & Data Protection notice, under KVKK and the GDPR.
- The parties accept that system records, server logs and electronic correspondence constitute evidence within the meaning of Article 193 of the Turkish Code of Civil Procedure No. 6100. This does not limit the consumer's statutory rights of proof.
16. Entry into force
This contract enters into force when the buyer confirms electronically and the payment is completed. A copy of the contract is sent to the buyer's e-mail address and kept permanently accessible from this page.
